1.1. The protection of your personal data is a priority for the Pedro & Susana Coelho, Lda, meaning that, under Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – GDPR), we are pleased to present our Privacy Policy. This will inform you of the rules applicable to the processing of your personal data, the rights you have, as well as how you can manage your respective consents.
1.2. The rules set out in this Privacy Policy complement the provisions on the protection and processing of personal data provided for in the “Booking Terms and Conditions” that regulate the offer of our accommodation and event services, advertised on the website casasupertubos.pt.
1.3. This Privacy Policy applies exclusively to the collection and processing of personal data carried out by CASASUPERTUBOS®.
2.1. Your data will be processed by Pedro & Susana Coelho, Lda (hereinafter referred to as CASASUPERTUBOS®), a limited liability company with registered office at Rua 1º de Dezembro, Nº 9, Casais Brancos, 2525-235 Atouguia da Baleia, Portugal, holder of tax identification number 514231882.
2.2. CASASUPERTUBOS® is the responsible for the processing of your personal data, within the meaning of the General Data Protection Regulation.
3.1. Personal data is any information, of any nature and regardless of its format, including sound and image, relating to an identified or identifiable natural person.
3.2. An identifiable person is one who can be identified directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural identity,or social identity of that natural person.
4.1. In the scope of its local accommodation activity and assisted booking management, CASASUPERTUBOS® will collect and process the personal data necessary for the contracting and stay of the Customer, namely the name, address, telephone number, email address, payment details, Internet Protocol (IP) address, tax identification number, and identification document/passport details.
5.1. Your personal data may be collected and processed by CASASUPERTUBOS® for the following purposes:
a) the lenght of legal obligations to which CASASUPERTUBOS® is subject, namely the invoicing of services purchased and the communication of foreign guest data to the authorities (AIMA);
b) the lenght of legal obligations, namely for the purposes of processing, confirmation and logistics of the accommodation booking or organisation of authorised events;
c) Contact management, customer support and any complaints;
d) Contact purposes, within the scope of CASASUPERTUBOS® marketing strategies, with information and commercial communications, namely through the sending of newsletters.
5.2. The failure to provide personal data for the purposes set out in points a) and b) results in non-compliance, by CASASUPERTUBOS®, with contractual and legal obligations imposed on it, which constitutes grounds for the non-conclusion of the booking contract, without any right to compensation or indemnity.
6.1. The processing of your personal data for billing and reservation purposes will be carried out on the basis of the performance of the service contract entered into and in strict compliance with legal obligations imposed on CASASUPERTUBOS®, namely in matters of tax legislation and border control (points b) and c) of Article 6(1) of the GDPR).
6.2. For contact management and complaints purposes, CASASUPERTUBOS® will process data based on the legitimate interest pursued by itself, as well as by the Customer (point f) of Article 6(1) of the GDPR).
6.3. The lawfulness of the processing of personal data collected for marketing and newsletters purposes is based exclusively on the express consent given by the data subject (point a) of Article 6(1) of the GDPR).
7.1. Without prejudice to legal, regulatory provisions or court orders to the contrary, the personal data collected will only be retained for the minimum period necessary for the purposes for which it was collected.
7.2. The retention periods defined for the purposes of CASASUPERTUBOS® are as follows:
i. Transaction management and billing: legal retention period of 10 years;
ii. Marketing and Newsletters: 2 years (including the current year) since the last interaction;
iii. Website or form user management: 1 year (including the current year) after the last access;
iv. Record and proof of transactions for distance contracts: 6 months after the contract period has ended.
8.1. CASASUPERTUBOS® may, from time to time, need to share some of your personal data with other recipients, including:
a) Public authorities to which CASASUPERTUBOS® is legally required to provide information, namely the Autoridade Tributária (AT) and Agency for Integration, Migration and Asylum (AIMA);
b) Processors who provide certain services under a subcontracting agreement, for the sole purpose of providing technical assistance to CASASUPERTUBOS®, such as server/website hosting providers, email service providers and invoicing software providers;
c) Competent authorities to which CASASUPERTUBOS® is legally required to provide information in the context of judicial or security proceedings.
8.2. Exceptionally and subject to certain conditions, CASASUPERTUBOS® may transfer your personal data to countries outside the European Union territory, in accordance with applicable legislation, for the purposes of data hosting or storage, technical subcontracting of processing, back-up and recovery of hosted data, and service development.
A CASASUPERTUBOS® ensures that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR.
9.1. Under the GDPR, you may request, at any time, the following rights:
a) Right of Access: Right to obtain confirmation as to whether or not your data is being processed and to access the detailed information provided for by law;
b) Right to Rectification: Right to obtain, without undue delay, the rectification of inaccurate or incomplete personal data concerning you;
c) Right to Erasure (“Right to be Forgotten”): Right to obtain the deletion of your data when it is no longer necessary for the original purpose or when you withdraw your consent (provided there are no legal retention obligations, such as billing);
d) Right to Restriction of Processing: Right to temporarily suspend processing in cases of disputed accuracy or objection;
e) Right to Object: Right to object, at any time, on grounds relating to your particular situation, to processing based on legitimate interests
f) Right to Data Portability: Right to receive the data you have provided in a structured, commonly used and machine-readable format.
9.2. If the requests made are manifestly unfounded or excessive due to their repetitive nature, CASASUPERTUBOS® may charge a reasonable fee based on administrative costs or refuse to comply with the request.
9.3. You also have the right to lodge a complaint directly with the national supervisory authority: National Data Protection Commission (CNPD).
10.1. Within the scope of the consent you have given, CASASUPERTUBOS® may promote new accommodations, offers or services via email, telephone or SMS.
If you do not wish to continue receiving these communications, you may object or withdraw your consent at any time. For this purpose, you should contact us via email. reserve@casasupertubos.com, clearly stating this request.
11.1. We are committed to keeping your personal data secure, and therefore we apply the appropriate technical and organisational measures to ensure a level of security appropriate to the risk of storing the data.
11.2. However, the transmission of information via the Internet is not completely secure, and we cannot guarantee the absolute security of information transmitted through our website resulting from the use of public networks.
11.3. We fully respect the confidentiality of your information. We do not sell, distribute or commercialise your data to third parties.
