The rules set out in this Privacy Policy complement the provisions on the protection and processing of personal data provided for in the \u201cBooking Terms and Conditions\u201d<\/b> that regulate the offer of our accommodation and event services, advertised on the website casasupertubos.pt<\/b>.<\/p>

1.3. This Privacy Policy applies exclusively to the collection and processing of personal data carried out by CASASUPERTUBOS\u00ae.<\/p>

2. WHO ARE WE?<\/h2>

2.1. Your data will be processed by Pedro & Susana Coelho, Lda <\/b>(hereinafter referred to as CASASUPERTUBOS\u00ae), a limited liability company with registered office at Rua 1\u00ba de Dezembro, N\u00ba 9, Casais Brancos, 2525-235 Atouguia da Baleia, Portugal, holder of tax identification number 514231882<\/b>.<\/p>

2.2. CASASUPERTUBOS\u00ae is the responsible for the processing of your personal data<\/b>, within the meaning of the General Data Protection Regulation.<\/p>

3. WHAT IS PERSONAL DATA?<\/h2>

3.1. Personal data is any information, of any nature and regardless of its format, including sound and image, relating to an identified or identifiable natural person.<\/p>

4. WHAT TYPES OF PERSONAL DATA DO WE COLLECT?<\/h2>

4.1. In the scope of its local accommodation activity and assisted booking management, CASASUPERTUBOS\u00ae will collect and process the personal data necessary for the contracting and stay of the Customer, namely the name, address, telephone number, email address, payment details, Internet Protocol (IP) address, tax identification number, and identification document\/passport details<\/b>.<\/p>

5. WHY DO WE PROCESS YOUR INFORMATION?<\/h2>

5.1. Your personal data may be collected and processed by CASASUPERTUBOS\u00ae for the following purposes:<\/p>

  • a) the lenght of legal obligations<\/b> to which CASASUPERTUBOS\u00ae is subject, namely the invoicing of services purchased and the communication of foreign guest data to the authorities (AIMA);<\/p><\/li>

  • b) the lenght of legal obligations<\/b>, namely for the purposes of processing, confirmation and logistics of the accommodation booking or organisation of authorised events;<\/p><\/li>

  • c) Contact management, customer support and any complaints;<\/p><\/li>

  • d) Contact purposes, within the scope of CASASUPERTUBOS\u00ae marketing strategies, with information and commercial communications, namely through the sending of newsletters<\/b>.<\/p><\/li><\/ul>

    5.2. The failure to provide personal data for the purposes set out in points a) and b) results in non-compliance, by CASASUPERTUBOS\u00ae, with contractual and legal obligations imposed on it, which constitutes grounds for the non-conclusion of the booking contract<\/b>, without any right to compensation or indemnity.<\/p>

    6. GROUNDS FOR THE LAWFULNESS OF PROCESSING<\/h2>

    6.1. The processing of your personal data for billing and reservation purposes will be carried out on the basis of the performance of the service contract<\/b> entered into and in strict compliance with legal obligations imposed on CASASUPERTUBOS\u00ae, namely in matters of tax legislation and border control (points b) and c) of Article 6(1) of the GDPR).<\/p>

    6.2. For contact management and complaints purposes, CASASUPERTUBOS\u00ae will process data based on the legitimate interest<\/b> pursued by itself, as well as by the Customer (point f) of Article 6(1) of the GDPR).<\/p>

    6.3. The lawfulness of the processing of personal data collected for marketing and newsletters purposes is based exclusively on the express consent<\/b> given by the data subject (point a) of Article 6(1) of the GDPR).<\/p>

    7. HOW LONG DO WE KEEP YOUR INFORMATION?<\/h2>

    7.1. Without prejudice to legal, regulatory provisions or court orders to the contrary, the personal data collected will only be retained for the minimum period necessary<\/b> for the purposes for which it was collected.<\/p>

    7.2. The retention periods defined for the purposes of CASASUPERTUBOS\u00ae are as follows:<\/p>

    • i. Transaction management and billing:<\/b> legal retention period of 10 years<\/b>;<\/p><\/li>

    • ii. Marketing and Newsletters:<\/b> 2 years<\/b> (including the current year) since the last interaction;<\/p><\/li>

    • iii. Website or form user management:<\/b> 1 year<\/b> (including the current year) after the last access;<\/p><\/li>

    • iv. Record and proof of transactions for distance contracts:<\/b> 6 months<\/b> after the contract period has ended.<\/p><\/li><\/ul>

      8. WHO MAY WE SHARE YOUR PERSONAL DATA WITH?<\/h2>

      8.1. CASASUPERTUBOS\u00ae may, from time to time, need to share some of your personal data with other recipients, including:<\/p>

      • a) Public authorities to which CASASUPERTUBOS\u00ae is legally required to provide information, namely the Autoridade Tribut\u00e1ria (AT)<\/b> and Agency for Integration, Migration and Asylum (AIMA)<\/b>;<\/p><\/li>

      • b) Processors<\/b> who provide certain services under a subcontracting agreement, for the sole purpose of providing technical assistance to CASASUPERTUBOS\u00ae, such as server\/website hosting providers, email service providers and invoicing software providers;<\/p><\/li>

      • c) Competent authorities to which CASASUPERTUBOS\u00ae is legally required to provide information in the context of judicial or security proceedings.<\/p><\/li>

      • d) Organizations and\/or companies affiliated with CASASUPERTUBOS\u00ae, provided they comply with an equivalent policy regarding personal data protection;<\/li><\/ul>

        8.2. Exceptionally and subject to certain conditions, CASASUPERTUBOS\u00ae may transfer your personal data to countries outside the European Union territory, in accordance with applicable legislation, for the purposes of data hosting or storage, technical subcontracting of processing, back-up and recovery of hosted data, and service development.
        A CASASUPERTUBOS\u00ae ensures that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR.<\/p>
